**MSHRC Closes Proceedings in Akshay Anna Shinde Encounter Case**

*Mumbai:* The Maharashtra State Human Rights Commission (MSHRC) has formally closed its proceedings regarding the alleged encounter involving 24-year-old Akshay Anna Shinde. The Commission noted that the matter has already been addressed through a criminal writ petition before the High Court.

Further, the Supreme Court has taken cognizance of the case and constituted a Special Investigation Team (SIT) to conduct a thorough investigation.

### Commission Notes Matter Under Judicial Process

The MSHRC observed that since both the offence and inquiry into the accidental death are being handled under appropriate criminal and procedural laws, the case must proceed through the due process of law.

### Judicial Panel Gives Clean Chit to Police

Separately, a Judicial Commission led by former Allahabad High Court Chief Justice Dilip Bhosale has exonerated the police in the alleged encounter case.

### SIT Formed Under Court Supervision

In its order, the MSHRC cited the High Court’s directive for the formation of an SIT under the supervision of Shri Lakhmi Gautam, Joint Commissioner of Police, Crime Branch, Mumbai. The High Court had emphasized that the case required further investigation.

The SIT was instructed to take lawful action and bring the case to its logical conclusion. Subsequently, the Magisterial Inquiry report and other relevant documents held by the High Court were handed over to the SIT as per an order dated April 30, 2025.

The Assistant Commissioner of Police and Investigating Officer of the SIT submitted a report dated July 24, 2025, clarifying the developments related to the inquiry.

The State of Maharashtra challenged the High Court’s judgment by filing a Special Leave Petition (SLP), which was decided on May 5, 2025. The Supreme Court modified the High Court’s order by directing that the SIT be constituted by the Director General of Police and supervised by the same officer.

Additionally, the Supreme Court clarified that registering a second FIR was unnecessary, and the concerned parties could approach the competent court for any appropriate relief.

### Parents Express No Grievance

The Commission also recorded statements from Akshay Shinde’s parents, who clearly stated they have no grievances regarding their son’s death and do not wish to seek compensation from the State.

### Incident Occurred During Police Custody Transfer

Akshay Shinde passed away while in police custody, having been handed over from Taloja Central Prison to the police for investigation in an unrelated case.

#### Police Version of the Incident

According to the police report submitted to MSHRC, the incident occurred en route to the Crime Branch office in Thane. Police stated that Akshay Shinde allegedly snatched the service revolver of Police Inspector Nilesh More and fired three rounds, injuring More in the left thigh.

In response, Police Inspector Sanjay Shinde reportedly fired in “private defence,” wounding Akshay Shinde, who was later declared dead at Jupiter Hospital in Thane.
